What a notice needs
Under 17 U.S.C. 512(c)(3), your notice must include:
- A physical or electronic signature of the copyright owner or a person authorised to act for them.
- Identification of the copyrighted work you say is infringed, or a representative list if there are several.
- Identification of the material you say is infringing, with enough detail for us to find it, such as the exact URL.
- Your name, address, phone number and email address.
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
A notice missing these parts may not be valid. Knowingly false claims can make you liable for damages under 17 U.S.C. 512(f).
03
What we do
When we get a valid notice, we remove or disable access to the material, and where we can, we tell the person who provided it and send them a copy of the notice.
04
Counter-notices
If your material was removed and you believe it was a mistake or misidentification, you can send a counter-notice to the same address. Under 17 U.S.C. 512(g)(3) it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed because of a mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district where we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We forward valid counter-notices to the original complainant. If they do not tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days of receiving the counter-notice.
05
Repeat infringers
We will end the access of anyone, such as a Toolbench submitter or newsletter contributor, who repeatedly infringes copyright, in appropriate circumstances.
